Terms of Service

By accessing or using Wowzey (wowzey.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users — Creators, Recipients, and Contributors.

We may update these terms. Continued use after updates constitutes acceptance. Material changes will be notified via SMS or in-app notification with 7 days' advance notice.

Wowzey is an interactive digital gifting platform that allows authenticated users (“Creators”) to create personalised, interactive experiences shared as URLs. Recipients open experiences in their browser. Contributors may add content to group experiences via invite links.

We provide the platform, hosting, delivery infrastructure, and AI tools. We do not create the content — Creators do.

Eligibility: You must be at least 13 years old to create an account. By registering, you confirm you meet this requirement. If you are between 13 and 18 years old, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf.

Authentication: Accounts are accessed via OTP sent to your mobile number (WhatsApp or SMS). You are responsible for keeping your OTP private. Do not share OTPs.

Account accuracy: Provide accurate information during registration. Using false identities or impersonating others is prohibited.

One account per person: Creating multiple accounts to circumvent limits or bans is prohibited.

You agree not to use Wowzey to:

• Send harassing, abusive, threatening, or hateful content to any recipient.
• Upload content that infringes third-party intellectual property rights (photos you don't own, copyrighted music, etc.).
• Share experiences containing nudity, sexual content, violence, or content that glorifies self-harm.
• Impersonate other individuals or organisations.
• Use the platform for spam, phishing, or distributing malware.
• Reverse-engineer, scrape, or attempt to extract data from the platform without permission.
• Circumvent rate limits, quotas, or payment requirements.

We reserve the right to remove content and suspend or terminate accounts that violate these terms, without prior notice in cases of severe violation.

Your ownership: You retain ownership of photos, text, and other content you upload. By uploading content, you grant Wowzey a limited, non-exclusive licence to store, process, and serve that content as necessary to provide the experience to the recipient.

Our moderation: All content submitted to group experiences (contributions) is screened via automated moderation. We use OpenAI Moderation API for text and Google Vision SafeSearch for images. Content that violates our policies is rejected automatically. Creators can review and approve contributions before publishing.

Report mechanism: Recipients can report inappropriate experiences. Reported experiences are reviewed by our moderation team within 24 hours.

Content removal: We may remove content without notice if it violates these terms or applicable law. You can delete your experiences and account data at any time from Settings.

The “AI Message” feature uses OpenAI's GPT-4o model to generate personalised text based on inputs you provide (recipient name, shared memories, tone). The generated content is shown to you for review before it becomes part of any experience. You must explicitly approve the AI-generated output — nothing goes live without your confirmation.

AI is unlimited on all plans. On the Free plan, a short advertisement may be displayed after each AI generation to fund the cost of the service. On any paid plan, AI generation is completely uninterrupted with no ads shown.

AI-generated content may occasionally be inaccurate, offensive, or inappropriate. It is your responsibility to review all AI output before publishing. Wowzey is not liable for AI-generated content you choose to publish.

Currency: All prices are in Indian Rupees (INR). International cards are accepted; your bank may apply foreign transaction fees.

Subscriptions: Paid subscriptions auto-renew each month/year. You may cancel anytime from Settings → Billing. Cancellation takes effect at the end of the current billing period.

Refunds: Monthly plans: no refund for the current period once charged. Annual plans: 7-day full refund from the date of purchase if you are unsatisfied. Contact hello@wowzey.com with your order ID.

Pay-per-use: Pay-per-use purchases (watermark removal, group video slots, Wedding RSVP upgrade, etc.) are non-refundable once redeemed.

Failed payments: If a payment fails, we notify you and your subscription downgrades to Free at the end of the current period.

Payments are processed by Razorpay. By making a payment, you also agree to Razorpay's terms of service.

The Free tier is subject to feature limits (group contributors capped at 5, 3 basic themes only, etc.) as defined on our current pricing page. Experience creation is unlimited on the Free tier. We reserve the right to adjust these limits at any time with 7 days' notice.

AI generation is unlimited on the Free tier. In exchange, a short ad may be displayed after each AI generation. You may remove ads by upgrading to any paid plan.

Free tier experiences include a Wowzey watermark. This watermark may not be removed or obscured without purchasing a one-time watermark removal or upgrading to a paid plan.

Advertising on the Free tier: The Free plan may be ad-supported. Where ads are shown, they are served by Google AdSense and appear only within your creator dashboard and inline after AI generation — never to recipients viewing your experience links. By using the Free plan, you consent to seeing such advertisements and to Google AdSense collecting anonymised signals (browser type, approximate location, ad interaction data) as described in our Privacy Policy and Google's Privacy Policy.

Scheduled delivery is a best-effort service. While we aim to deliver at the scheduled time, delivery may be delayed by up to 5 minutes due to queue processing. Wowzey is not responsible for delays caused by third-party delivery providers (Msg91, WhatsApp infrastructure, SMS networks).

If a scheduled delivery fails after 3 attempts, we notify the creator with the manual share link. The experience link remains valid permanently.

Experience links are permanent and do not expire unless the creator manually deletes the experience or their account is terminated for policy violations. Creators on the Free plan who downgrade from a paid plan do not lose access to previously created experiences.

The Wowzey platform, including all software, design, animations, and branding, is the intellectual property of the team operating Wowzey. You may not copy, modify, or redistribute any part of the platform without written permission.

The Wowzey name and logo are proprietary to Wowzey. Formal company registration and trademark details will be published here once the operating entity is incorporated.

The service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability, though we target 99.5% uptime.

To the maximum extent permitted by Indian law, Wowzey's total liability for any claim arising from use of the service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for: loss of user content due to hardware failure (covered by daily backups), emotional distress caused by AI-generated content you chose to publish, or third-party delivery delays.

These terms are governed by the laws of India. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
